ACCEPTANCE
OF AGREEMENT
You agree to the terms and conditions outlined in
this Agreement. This Agreement constitutes the
entire and only agreement between Us and you, and
supersedes all prior or contemporaneous agreements,
representations, warranties and understandings with
respect to the Site, the content, products or
services provided by or through the Site. This
Agreement may be amended at any time by Seafire
Salt without notice to you. The most current
Agreement will be the one posted on the Site at
http://www.seafiresalt.com/terms.html, and you
should read and understand the Agreement prior to
using the Site.
COPYRIGHTS
AND TRADEMARKS
Seafire Salt respects the intellectual property of
others, and we ask you to do the same. If you
believe that your work has been copied in a way
that constitutes copyright infringement, please
notify us at (505) 281-5044 so that we may address
it immediately. All content on this Site,
including, but not limited to, content,
organization, text, graphics, logos, images,
compilation, magnetic translation, digital
conversion and other matters related to the Site,
is the property of The Seafire Salt Company and
Kandis Corp. ("We" or "Us") or its content
suppliers and as such is protected by United States
and International copyright, trademark,
intellectual property and patent laws. All software
used on the Site is the property of Kandis Corp. or
its software suppliers and is likewise protected.
The copying, redistribution, use or publication of
any part of the Site is strictly prohibited, except
as allowed by the Limited Rights to Use section of
this Agreement. Seafire Salt is a trademark of
Kandis Corp. Other product and company names
mentioned on the Site may be trademarks of Kandis
Corp. or their respective owners.
LIMITED
RIGHT TO USE
Kandis Corp. grants you only a limited,
non-exclusive license to access and make personal
use of the site. You may not download, modify,
republish, distribute, assign, sublicense, sell,
make derivative works or otherwise use any portion
of the Site without the express written consent of
of Kandis Corp. No part of any content, form,
document, image, product listing, description or
prices may be reproduced, duplicated, downloaded,
copied, sold, resold, visited or otherwise
exploited for any commercial purpose without
written consent of Kandis Corp.
You
may not use frames or framing techniques to display
any portion of the Site elsewhere, nor use metatags
or any other form of "hidden" text which utilize
Seafire Salt, Kandis corp. owned names, logos,
trademarks and other proprietary, copyright
protected information. You may create a link to the
homepage of the Site, provided the link does not
portray Seafire Salt, Kandis Corp., the Site or its
products, services or contents in a false,
misleading, derogatory or otherwise offensive
matter. This permission is granted as a limited,
revocable, non-exclusive right and may be revoked
at any time, for any reason.
Any
unauthorized use terminates all permission and
licenses that may have been previously
granted.
FAIR
USE
We recognize Fair Use conventions for scholastic
and journalistic purposes, provided they do not
conflict with the spirit and intent of the Limited
Rights to Use above.
DISPUTES
AND APPLICABLE LAW
This Agreement shall be treated as though it were
executed and performed in the State of New Mexico,
and shall be governed and construed in accordance
with the laws of that state, without regard to
conflict of law principals. Any dispute relating in
any way to your visit to the Site, including, but
not limited to purchases, must be instituted within
one (1) year after the cause of action arose or be
forever waived and barred. All disputes shall be
submitted to confidential arbitration in New
Mexico, subject to the then prevailing rules of the
American Arbitration Association. To the extent
that anything in, on, or associated with, the Site
is in conflict or inconsistent with this Agreement,
this Agreement shall take precedence. Our failure
to enforce any provision of this Agreement shall
not be deemed a waiver of such provision nor of the
right to enforce such a provision. Should any part
of this Agreement be found invalid or
unenforceable, that portion shall be construed
consistent with applicable law and the remaining
portions shall remain in full force and effect. By
visiting the Site, you agree that you will comply
with all applicable laws, statutes, ordinances and
regulations regarding use of the Site, our products
and services, and your purchases and browsing,
consistent with the laws of the State of New Mexico
and additionally with the laws of the location
where you visit the Site from.
DISCLAIMER
OF WARRANTIES, LIMITATION OF LIABILITY AND
INDEMNIFICATION

provided "As-Is" and "As Available" and Kandis
Corp. makes no representations or warranties of any
kind, express or implied. Kandis Corp. disclaims
all warranties, including, without limitation,
warranties of merchantability, fitness for a
particular purpose and non-infringement. You
expressly agree that your use of this site is at
your sole risk. Kandis Corp. does not warrant that
this site, its servers, or e-mail sent from the
Site are free of viruses or other harmful
components.
Seafire
Salt, Kandis Corp. and our affiliated parties will
not be liable for any indirect, special, incidental
or consequential damages of any kind, including,
but not limited to, damages for loss of business,
loss of profits or litigation, whether based on
breach of contract, breach of warranty, tort
including negligence, product liability or
otherwise, even if advised of such damages. The
negation of damages set forth herein are
fundamental elements of the basis of the bargain
between Us and you, and the Site and information
would not be provided to you without such
limitations.
We
will not be liable to you for any damages of any
kind arising from your voluntary use of the Site,
and our maximum liability to you under all
circumstances will be equal to the purchase price
you actually pay to Us for any good, services or
information.
No
advice or information, whether oral or written,
that is obtained by you through Us shall create any
warranty, representation or guarantee not expressly
stated in this Agreement. Further, you agree to
indemnify, defend and hold us, our partners,
employees, staff, subsidiaries, attorneys and
affiliates harmless from any liability, loss, claim
and expense, including reasonable attorneys' fees,
related to your violation of this Agreement or any
use of the Site.

TO OTHER WEB SITES
We may allow access to or advertise third-party
merchant sites from whom you may purchase certain
goods or services. Such access to such third-party
merchants may be in the form of links, logos,
images, descriptive wording or advertisements. We
are not responsible for the content, accuracy or
opinions expressed in such third-party sites.
Inclusion of any linked third-party web site on our
Site does not imply approval or endorsement of the
linked web site(s) by Us. If you leave our Site and
access these third-party web sites, you do so at
your sole risk and is without warranties of any

and you authorize Us, to the use and assignment of
all information the Site uses from you in any
manner consistent with our Privacy Policy. You
warrant that you own or control all of the rights
to any content or information that you post or
submit, that such content is accurate, and that you
will indemnify and defend Us for all claims
resulting from content you supply.
We
have the right, but not the obligation, to edit,
delete or monitor any activity and content
